On Tuesday, Louisiana Governor John Bel Edward extended Phase 2 through August 7th, amending the mask mandate and other restrictions that went into effect on July 13th. The LA Association of Business and Industry (LABI) released information about the new laws from this past legislative session on the limits of liability to businesses from the COVID-19 pandemic. Act 336 provides civil liability protection to those who meet its requirements, while House Bill 826 was passed to protect businesses who have stepped up to keep LA safe and substantially comply with federal, state and local guidance as they seek to re-hire workers, re-open their doors and begin growing again.
The EEOC has created a guide that reviews what you should know about COVID-19 and the ADA, the Rehabilitation Act, and other EEO laws. One thing everyone should be aware of is that testing employees for antibodies brings up issues with heredity testing, so you are not allowed to make them mandatory for employees. Furthermore, the US Department of Labor (DOL) has issued more Coronavirus-related guidance for workers and employers about their rights and responsibilities under federal leave, wage and hour laws. Questions such as whether employees should be paid for unauthorized telework hours and more have been addressed by the DOL.
